Terms of Service

By accessing or using any CARDANA service—including CARDANA Chat, Learn, Studio, Projects, Agents, and Code—you agree to be bound by these Terms of Service and our Privacy Policy.

If you are using CARDANA on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

CARDANA is an adaptive AI platform providing various services including:

• Chat: Conversational AI for research and assistance
• Learn: Adaptive educational platform
• Studio: AI-powered image, video, and audio generation
• Projects: AI-assisted project management and execution
• Agents: Autonomous AI systems for tasks
• Code: AI-assisted development environment

Services may evolve over time, and we reserve the right to modify, suspend, or discontinue any feature with reasonable notice.

To use CARDANA services, you must:

• Be at least 13 years old (or meet the minimum age requirement in your jurisdiction)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access

You are responsible for all activity that occurs under your account.

Credits System: Certain CARDANA services (particularly Studio) operate on a credits-based system. Credits are used to generate content and access premium features.

Purchases: Credit purchases are processed by Stripe. All purchases are final and non-refundable except as required by law or at our discretion.

Credit Expiration: Purchased credits do not expire. Promotional or bonus credits may have expiration dates as specified at the time of grant.

Pricing: We reserve the right to change pricing at any time. Price changes will not affect credits already purchased.

Subscriptions: If you subscribe to a plan, it will automatically renew unless cancelled before the renewal date. You can cancel at any time through your account settings.

You agree NOT to use CARDANA to:

• Generate illegal, harmful, or abusive content
• Create deepfakes or misleading media intended to deceive
• Harass, threaten, or impersonate others
• Generate child sexual abuse material or content sexualising minors
• Create content that infringes intellectual property rights
• Distribute malware or engage in hacking activities
• Circumvent usage limits or access controls
• Use automated systems to abuse the service
• Resell or redistribute generated content commercially without proper licensing

We reserve the right to suspend or terminate accounts that violate these policies.

Your Input: You retain ownership of content you provide as input (prompts, uploaded files, etc.).

Generated Content: Subject to the terms of underlying AI model providers, you own the content generated through CARDANA services, provided you have sufficient credits and comply with these terms.

License to Us: You grant CARDANA a license to use, process, and store your content as necessary to provide and improve our services.

AI Provider Terms: Generated content may be subject to additional terms from AI model providers (e.g., OpenAI, ElevenLabs). You are responsible for complying with applicable upstream terms.

CARDANA, its logos, design, and all platform code and content are owned by The CARDANA AI and protected by intellectual property laws.

You may not copy, modify, distribute, or reverse engineer any part of our platform without explicit permission.

AI-generated content may contain errors, inaccuracies, or biases. You acknowledge that:

• Generated content should not be relied upon as professional advice (legal, medical, financial, etc.)
• You are responsible for reviewing and verifying generated content before use
• AI outputs may occasionally produce unexpected or inappropriate results
• Generated content may inadvertently resemble existing copyrighted works

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CARDANA services are provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not responsible for third-party services or content

You agree to indemnify and hold harmless CARDANA, The CARDANA AI, and our affiliates from any claims, damages, or expenses arising from:

• Your use of the services
• Content you create or distribute
• Your violation of these terms
• Your violation of any third-party rights

By You: You may close your account at any time through account settings or by contacting support.

By Us: We may suspend or terminate your access for violation of these terms, suspected fraud, or for any reason with reasonable notice.

Effect: Upon termination, your right to use the services ceases. Provisions that should survive (IP rights, limitations of liability, indemnification) will remain in effect.

We may update these terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance.

If you disagree with changes, you should stop using the services and close your account.

These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales, unless otherwise required by consumer protection laws in your jurisdiction.

If any provision of these terms is found unenforceable, the remaining provisions will continue in effect.
